Legal notice for recovery in Visakhapatnam
A legal notice is a formal demand from an advocate that sets out what the buyer owes, gives a deadline and says what happens next. For Visakhapatnam businesses FundRaksha Legal sends it within 24 hours of complete documents, then negotiates, and if needed files before the Andhra Pradesh Micro and Small Enterprises Facilitation Council, a commercial court or, for a bounced cheque, the magistrate. No upfront fee; 30% only on what is recovered.
What a recovery notice must contain
- Your name, business and GSTIN, and the buyer's legal name, GSTIN and registered address
- Each unpaid invoice with its number, date, amount and due date, and the total outstanding
- How the goods or services were delivered and accepted: challans, e-way bills, LR copies, acceptance emails
- The credit terms agreed, and any part payments already received
- Interest claimed: the contract rate, or for a Udyam-registered micro or small supplier, compound interest at three times the RBI bank rate under Section 16 of the MSMED Act
- A clear deadline to pay, usually 7 to 15 days
- What you will do if the buyer does not pay: MSME Samadhaan, a civil or summary suit, or a Section 138 complaint
- The advocate's signature and enrolment details
How it is delivered
The notice goes by speed post with acknowledgement due to the buyer's registered and business addresses, and on the same day by email and WhatsApp to the people you deal with. Keep the postal receipt, the tracking report, the email record and a screenshot of the WhatsApp delivery ticks. Electronic delivery is increasingly accepted as proof that the buyer knew of the demand, but the postal copy remains the safest proof.

Recovery in Visakhapatnam: local context
Visakhapatnam suppliers to the steel plant's ecosystem, ports and large contractors often wait months on bills that are not disputed. MSME Samadhaan is the strongest lever for micro and small suppliers here, even though the state council sits at Mangalagiri: filing is online and hearings can be attended through an advocate.
Worked example. An Autonagar engineering unit completed ₹11,90,000 of fabrication for a port contractor, with the bill unpaid for four months. The invoice is dated 9 June 2026. With 45-day credit, the payment fell due on 24 July 2026. The notice claims ₹11,90,000 plus interest from 24 July 2026, with a 15-day deadline. If the buyer pays the principal after the notice, our fee is ₹3,57,000 (30%) and you keep ₹8,33,000. A suit for this invoice would have to be filed before about 24 July 2029 unless the buyer acknowledges the debt in writing.
What happens next if the buyer does not pay
MSME Samadhaan (for Udyam-registered micro and small suppliers). A Visakhapatnam supplier's reference is heard by the Andhra Pradesh Micro and Small Enterprises Facilitation Council, Office of the Commissioner of Industries, 8th Floor, APIIC Towers, Auto Nagar, Mangalagiri, Guntur District. The Samadhaan portal lists one state council for Andhra Pradesh, at Mangalagiri. Under Section 18(4) of the MSMED Act the council where the supplier is located has jurisdiction, even if the buyer is in another state. The council first tries conciliation, then arbitrates; a buyer who wants to challenge the award must first deposit 75% of it (Section 19). Retail and wholesale traders registered on Udyam only for priority sector lending cannot use this route.
Commercial court or summary suit. Commercial disputes of ₹3 lakh or more go to the commercial court for Visakhapatnam, with appeals to the Andhra Pradesh High Court at Amaravati. Under Order XXXVII of the Code of Civil Procedure, a summary suit on a written contract or a debt can be decided quickly: the buyer must apply for leave to defend within 10 days of being served, and without it the court can pass a decree.
Section 138, if a cheque bounced. A dishonoured cheque gives a separate criminal remedy with strict deadlines. See cheque bounce lawyer in Visakhapatnam.
